Terms of Use

The present Terms of Use (hereinafter "TOU") shall constitute an agreement between:

Article 1 - Purpose

The purpose of the present Terms of Use (hereinafter the "TOU") is to define the terms of use for any person navigating on (hereinafter the "User") the Website (hereinafter the "Website") of the Publisher. The purpose of the Publisher's Website is the online sale of jewelry products. Exceptionally, the Publisher may agree to modify, add or delete provisions of these TOU by written agreement.

The Publisher reserves the right to modify or update the present TOU without justification or prejudice, that is why the Publisher recommends to the Users to systematically review the TOU before any new navigation on the Website. The date of the last update of these TOU appears at the top of this page in bold.

 

Article 2 - Scope of application

These TOU apply to any User visiting the Website. By accessing the Website, the User acknowledges having read and accepted these Terms and Conditions, which set out his rights and obligations when browsing the Website.

 

Article 3 - Website

1 – Accessibility

The Publisher's Website is located at the following address: www.odace.co. Access to the Website is free of charge for all Users with Internet access, however the costs incurred by the User for the connection and use of the Internet are not borne by the Publisher.

Each User acknowledges that he/she is over 16 years of age or is accompanied by a legal guardian in order to browse the Website.

2 – Content

The Publisher puts online the content present on the Website and ensures by all possible measures the accuracy and validity of the information online on the Website. The Publisher reserves the right to modify or update the content without justification or prejudice.

It is possible that the content of the Website contains inaccurate, incomplete or erroneous information resulting from a technical or involuntary error on the part of the Publisher. The Publisher undertakes to correct these errors in good faith, as soon as possible, as soon as he becomes aware of them.

3 – Personal account

The Publisher allows the User to create a personal account on the Website. The personal account allows the User to access a dedicated space on which the User can manage and view his orders, invoices and delivery address.

The User is required to keep his identifiers confidential. The Publisher allows the User to change the password of his personal account on request or to close his personal account at any time. The Publisher reserves the right to close/suspend the User's personal account at any time.

Article 5 – Hypertext links

The Publisher's Website may contain hypertext links redirecting the User to third party websites. Article 6 – Intellectual property

All the elements present on the Publisher's Website are subject to a right reserved under Article L111-1 of the French Intellectual Property Code. Article 7 – Liability

The Publisher affirms that it takes all necessary measures to ensure the proper functioning, security and accessibility of the Website. The Publisher is only bound by an obligation of means and not of results as to the measures aimed at the proper functioning, security and accessibility of the Website. The Publisher reserves the right to suspend at any time, temporarily or permanently, with or without notice, the access to the Website, particularly for reasons of technical maintenance or update. Moreover, the Publisher reserves the exclusive right to suspend the access to the Website to any User, and this without notice, in particular in the event of failure with any provision of the present TOU of the User.

The responsibility of the Publisher cannot be committed in case of:

  • - malfunction, security failure or partial or total unavailability of services or access to the Website
  • - direct or indirect damage resulting from the information present on the Website.

The responsibility of the Publisher cannot be committed for damage caused with the User or thirds resulting from a Use of the Website contrary to the present TOU on behalf of the User. The User is the only one responsible for the Use made of the Website and commits himself to indemnify and compensate the Publisher in case of damage, loss, or loss of profit of the Publisher caused by the User during the Use of the Website.

 

Article 8 – Partial invalidity

If one or more of the provisions of the present TOU are deemed invalid in application of a standard in force or a final decision emanating from a competent jurisdiction, the provisions not concerned by this invalidation remain applicable in their entirety.

 

Article 9 – Applicable Law and Jurisdiction

The present TOU are subject to French law. In case of dispute arising between the User and the Publisher, the parties will favor an amicable resolution of the dispute. Any dispute relating to the interpretation and/or the execution of these TOU is under the jurisdiction of the French courts.

Annexe : Code de la Propriété intellectuelle

L’auteur d’une oeuvre de l’esprit jouit sur cette oeuvre, du seul fait de sa création, d’un droit de propriété incorporelle exclusif et opposable à tous.

Ce droit comporte des attributs d’ordre intellectuel et moral ainsi que des attributs d’ordre patrimonial, qui sont déterminés par les livres Ier et III du présent code.

L’existence ou la conclusion d’un contrat de louage d’ouvrage ou de service par l’auteur d’une oeuvre de l’esprit n’emporte pas dérogation à la jouissance du droit reconnu par le premier alinéa, sous réserve des exceptions prévues par le présent code. Terms of Sale

These Terms of Sale (hereinafter "TOS") define the terms and conditions of a contract of sale via the online store located at WWW.ODACE.CO or via any physical outlet ODACE, temporary or not:

BETWEEN

Any person making a purchase via the website: www.odace.co or via any physical outlet ODACE, (hereinafter the "Customer")

AND

The company ODACE SAS, with the registration number 90471509100016 (SIRET) at the company register of Paris and domiciled at 6 rue d'Armaillé, 75017 Paris, France (hereinafter the "Seller").

Article 1 – Purpose and Scope of Application

These TOS apply in the case of distance selling of products by Seller via its online store located at WWW.ODACE.CO or via any ODACE physical store (hereinafter the "Store") to a Customer. These TOS define the reciprocal rights and obligations of the Seller and the Customer in case of remote purchase of jewelry products on sale in the Store of the Seller (hereinafter the "Products") or in case of purchase of jewelry products via any ODACE physical outlet.

The TOS set forth the rights and obligations of the Seller and the Customer (hereinafter referred to as the "Parties") in connection with an order placed by the Customer via the Seller's Store, without prejudice to the application of the provisions of the French Consumer Code specific to the Customer as a Consumer. By placing an order in the Seller's online store, the Customer acknowledges having read and accepted these TOS. The TOS in effect at the time the Customer places an order in the Store are deemed to be accepted without reservation by the Customer. If the Customer waives acceptance of these TOS, the said order shall be deemed void.

The Seller reserves the right to modify or update these TOS, which is why the Seller recommends that its Customers systematically reread the TOS before placing any order in the Store. The date of the last update of these TOS is shown at the top of this page in bold.

The TOS do not apply in cases where:

  • The Customer places an order in the Store as a natural or legal person for business purposes.
  • The Customer places an order in the Store as a Professional as defined by the French Consumer Code.

Article 2 – Order

To place an order via the Store, the Customer must proceed according to the following steps:

  1. Go to the online store at the following address: odace.co
  2. Select the desired Products and options if applicable
  3. Fill in the payment and shipping information
  4. Validate the order verification step indicating the price to be paid and the delivery terms of the order
  5. Follow the payment instructions

Once the order has been finalized via the Store, the Customer will receive a confirmation of the order from the Seller by e-mail. In the absence of an order confirmation from the Seller, the distance selling contract is deemed null and void, and the Customer is assured that no money is taken from him for the payment of this order, or if the payment has already taken place, the Customer is assured that the total amount paid for the order is returned to his bank account.

Any order placed in the Seller's Store shall be deemed a distance selling contract between the Customer and the Seller. The Parties are bound by a distance selling contract as defined in Article L221-1 of the French Consumer Code from the moment the order is confirmed by the Customer after viewing the details and final price of this order. These TOS are applicable to the sales contract between the Seller and the Customer. The Seller reserves the right to accept or refuse any order placed by a Customer. The Customer acknowledges that he/she is over 16 years of age to place an order in the Store.

Article 3 – Products

1 – Description of the Products

The Seller undertakes to offer the most accurate description and presentation possible of the essential characteristics of each Product displayed in the Store. The digital content made available to the Customer for the description of the Products, such as photos, videos or any other form of graphic illustration of the Products, is presented to the Customer for illustrative purposes only and shall not be binding on the Seller on a contractual basis. The Customer must therefore refer to the written description of the Products in order to know the exact description of the Products displayed in the Store.

In the event of an error in the display or description of the Products, the Seller reserves the right to correct them at any time and shall endeavor to notify the Customer and offer him:

  • either to renounce the purchase of the Product in question
  • or to confirm the purchase in view of the changes made to the description of the Product in question

If the Customer does not respond to the Seller within 7 days in the event of a correction to a change in the description of a Product, the Customer shall be deemed to have renounced the purchase.

2 – Unavailability of Products

The Seller cannot be held responsible for the unavailability of a Product. The Seller reserves the right to withdraw a Product from the Store at any time. In the event that one of the Products ordered by the Customer becomes unavailable after the order has been confirmed by the Seller, the Seller undertakes to contact the Customer as soon as possible to offer him:

  • either the replacement of the unavailable product by a similar product at an identical price
  • or the reimbursement of the unavailable product by the Seller to the Customer within thirty days.

3 – Personalized products at the request of the Customer

Some Products can be personalized with an engraving at the request of the Customer at the time of the order when the Customer clicks on the option "I want to engrave my jewel".

Each request for personalization of Products by the Customer is final and cannot be changed once the order is sent to the Seller. The Customer remains entirely responsible for the personalization requests submitted to the Seller.

Article 4 – Price

The prices of the Products are displayed in the Store with the description of each product and at the time of the summary of the order. The price displayed corresponds to the price of each Product, including all taxes and excluding delivery charges. The delivery costs are indicated at the time of the summary of the order and are included in the total price of the order. Delivery costs may vary depending in the type of delivery chosen. The total price of each order is payable in Euros (€).

The Customer is required to pay the price per Product displayed in the Store at the time of placing the order. However, the Seller reserves the right to modify the prices of the Products at any time.

Article 5 – Payment

The Payment corresponds to the payment of the total amount including all taxes of the Products and of the delivery if it is paying. The different methods of payment accepted in the Seller's Store appear at the time of the payment summary of the order. Bank transfers may be accepted as a means of payment in the Store when the Seller agrees to this in writing with the Customer. The Customer is obliged to pay the full amount of the order once the order has been placed via the Store and in particular once the Customer's bank details have been collected in the case of payment by bank transfer.

Article 6 – Exchanges

1 – Exchanges accepted for certain Products

Exchanges are accepted by the Seller without any reason within 14 days from the date of receipt of the order by the Customer, for the following Products:

  • Earrings ;
  • Necklaces ;
  • Bracelets ;
  • Rings, only for sizing requests.

An exchange of a Product in the categories "earrings", "necklace", or "bracelet" means the return of the Product ordered by the Customer in exchange for another Product. In the case of an exchange of a Product " earrings ", " necklace ", or " bracelet ", the Seller offers a voucher equivalent to the market value, all taxes included, of the exchanged Product(s), valid for 1 year in the Store as from the reception of the exchanged Products, if the Products are returned in their original condition with their certificate of authenticity issued by the Seller and in accordance with the conditions provided for in the last paragraph of Article 7 §1 of these TOS.

A "ring" Product exchange means the return of the Product ordered by the Customer in exchange for the same Product in 2 sizes larger or 2 sizes smaller maximum. Exchanges of "ring" Products are not accepted by the Seller if the Product requested for exchange is more than 2 sizes larger or 2 sizes smaller. The Customer is invited to refer to the size guide to know if a purchased "ring" Product is eligible for an exchange or not.

Products personalized with an engraving at the request of the Customer cannot be returned or exchanged by the Customer.

2 – Return or exchange instructions

In case of a return or exchange request, the Customer must contact the Seller by e-mail at hello@odace.co. The Seller will provide a shipping voucher as well as the shipping instructions to be followed for the exchange of the Products. The Customer undertakes to return the desired Products with their original packaging and their certificate of authenticity provided by the Seller, guaranteeing the proper transport and security of the Product. The shipping costs of the returned Products and of the new Products shall be borne by the Customer.

Article 7 – Returns for personalization

The Customer may return to the Seller Products that have not yet been personalized with an engraving in order to add a personalized engraving to the Product previously ordered by the Customer in the Store. To do so, the Customer must notify the Seller within a maximum of 1 year from the date the Customer placed the order in the Store.

In the event of a request to return Products for the addition of a personalized engraving, the Customer must contact the Seller by e-mail at hello@odace.co. The return of a Product by the Customer in order to add a personalized engraving is charged to the Customer at 40€ all taxes included. The reshipment of the Product to the Customer is at the expense of the Seller.

However, the Products having been the object of a personalized engraving at the request of the Customer can neither be returned nor exchanged by the Customer. For this reason, the Seller recommends that the Customer does not add a personalized engraving at the time of purchase if the Customer is not sure of the choice of model or size of the Product ordered.

Article 8 – Delivery

1 – Price

Delivery is free for orders delivered in France and the European Union. In the other hand, delivery costs are charged to the Customer for orders delivered outside the European Union. 

For orders shipped to a country outside the European Union, the Customer may be asked to pay additional customs fees unforeseen at the time of payment of the order if applicable. Any payment of customs fees concerning the delivery of Products ordered by the Customer are at the expense of the Customer.

2 – Delivery time

The delivery time of an order placed in the Store appears at the time of the order summary step before proceeding to the payment of the order. The Seller undertakes to ship the Customer's order once it has been paid in full, the Seller has been notified, and the Products ordered by the Customer are prepared and manufactured, within a maximum of 4 to 6 weeks.

The Seller undertakes to ensure delivery of the order within the period specified at the time of the order summary, however, this delivery time may be extended in the event of problems in the supply of materials necessary for the manufacture of the Products, excessive delay in the workshop manufacturing the Products, or delay by the carrier. If the delivery time indicated by the Seller at the time of the order summary is exceeded, the Customer may ask the Seller for a refund of the entire amount paid for the order. The Customer shall notify the Seller by e-mail. Upon receipt of the cancellation notice, if the Products have not already been shipped, the Seller shall refund the Customer within 14 days. Upon receipt of the cancellation notice, if the Products have already been shipped by the Seller, the Customer agrees to return the Products shipped by the Seller and the refund will be made within 14 days from the date of receipt of the returned Products to the Seller. In this case, the costs of returning the Products to the Seller shall be borne by the Seller.

3 – Conditions

Orders are delivered via DHL or Colissimo for packages sent to the European Union. Delivery may be made by another carrier for express deliveries and for deliveries outside the European Union. The terms & conditions of the carrier taking charge of the delivery of the order placed in the Store are applicable to the delivery. In case of absence of a receiver at the address chosen by the Customer for the delivery, the carrier leaves a notice of passage notifying the receiver of the attempted delivery. Delivery is considered to have been made once the order is received at the address chosen by the Customer at the time the order was placed.

Some orders may be shipped in multiple shipments, separating the Products for shipment. For orders requiring separate shipment of some Products, the order is considered received once all Products have been received.

The Customer is responsible for checking the condition of the package and the Products it contains. If the package is visibly damaged, the Customer may refuse the package to the delivery person, the Customer must inform the carrier by letter with acknowledgement of receipt within three (3) days of receipt of the package and inform the Seller by attaching a copy of the letter sent to the carrier.

Article 9 – Right of return

1 – Définition et extinction

Conformément aux dispositions du Code de la Consommation annexées ci-dessous, dans le cadre d’un achat effectué par un Client en tant que non-professionnel sur la Boutique en ligne du Vendeur, le Client dispose d’un délai de quatorze jours calendrier à compter de la réception du ou des Produit(s) commandés sur la Boutique en ligne pour exercer, auprès du Vendeur, son droit de rétractation sans préjudice ni justification.

Si ce délai de quatorze jours se termine un dimanche, jour férié ou non travaillé, ce délai est étendu jusqu’au prochain jour ouvrable. Certaines commandes pouvant être expédiées en plusieurs fois, le délai de quatorze jours commence à courir le jour de la réception du dernier Produit.

2 – Exercise

The right of return allows a refund of the total price paid by the Customer for one or more Products, including all taxes and delivery, without justification or prejudice. Additional costs resulting from a choice of delivery method other than the one recommended by the Seller cannot be reimbursed. Only the cost of the delivery method recommended by the Seller will be reimbursed within the framework of the right of return. The right of return is exercised even on products in promotion. In case of exercising the right of return, the Customer must return the desired Products in a packaging that ensures the proper transport and safety of the Product with the return form attached (Annex 1 of these TOS) and their original packaging and the certificate of authenticity issued by the Seller to the address:

The Seller undertakes to refund the Customer within fourteen days of the Customer. The reimbursement of the Customer is considered to have been made as soon as the Customer has received the corresponding sum by the means of payment used for the payment of the order. In case of exceeding the fourteen days to reimburse the Customer, the Seller shall be liable to the legal interest rates provided for in Article L242-4 of the Consumer Code.

3 – Exceptions

In accordance with the provisions of the Consumer Code annexed below, within the framework of a purchase made by a Customer as a non-professional in the Store, the Customer may not exercise his right of return for Products clearly personalized according to the Customer's specifications, such as Products personalized with an engraving, or Products specially manufactured at the Customer's request and not appearing in the Seller's catalog. 

Article 10 – Guarantees

1 – Legal guarantee of conformity (Consumer Code)

When purchasing Products via the Seller's online store, the Customer benefits from a legal guarantee of conformity. To act in legal guarantee of conformity, the Customer, as a Consumer:

  • has a period of two years from the delivery of the goods to act;
  • may choose between repair or replacement of the good, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
  • is exempted from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for used goods.

To exercise his or her right to legal warranty of conformity, the Customer must only contact the Seller's customer service department whose contact information is available in the Store site by providing proof of purchase of the Product in the Seller's Store with their certificate of authenticity issued by the Seller. To make a return within the framework of the exercise of the legal guarantee of conformity, the Customer must only contact the customer service of the Store at the following e-mail address: hello@odace.co, providing a proof of purchase of the Products with their certificate of authenticity issued by the Seller. The customer service of the Store will provide him with the instructions to follow.

The legal guarantee of conformity applies independently of the manufacturer's or commercial guarantee that may have been granted.

2 – Legal guarantee against hidden defects (Civil Code)

The Customer, as a consumer, can decide to use the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In application of the legal warranty against hidden defects, the Customer has a period of two years from the date of discovery of the defect to contact the Seller and notify it of the discovery of a defect. The defect corresponds to a defect in the Product such that it renders it unfit for the use for which it is normally intended.

The Customer can choose between the resolution of the sale, either the reimbursement of all taxes and delivery included, or a reduction of the sale price in accordance with article 1644 of the civil code.

In order to exercise his right to the legal guarantee against hidden defects, the Customer must only contact the Seller's customer service department, whose contact details are available in the Store, by providing proof of purchase of the Product in the Store. To make a return within the framework of the exercise of the legal guarantee of hidden defects, the Customer must only contact the customer service of the Store at the following e-mail address: hello@odace.co, providing proof of purchase of the Products. The customer service of the Store will provide him with the instructions to follow.

3 – Exercise of the manufacturer's warranty right

The Products sold in the Store by the Seller may be subject to a warranty issued by the manufacturer of these Products. If offered by the manufacturer, the warranty period for each Product is indicated in its description. Once the manufacturer's warranty period indicated in the Product description has expired, the return of the Product is no longer possible unless the Customer's right of return is applicable. In order to exercise his right of warranty, the Customer must only contact the Seller's customer service department whose contact details are available in the Store Website by providing proof of purchase of the Product in the Seller's Store.

The manufacturer's warranty of the Products does not apply to Products that are installed or assembled under the sole responsibility of the Customer. Installation and assembly under the sole responsibility of the Customer is necessary in cases where the Products are delivered as spare parts. In such cases of Products delivered in parts, assembly shall be performed in accordance with the documents and recommendations provided by Seller. In such cases, Seller shall not be responsible for installation, assembly or use of the Product that does not conform to its description, Seller's instructions and recommendations for the Product, or to applicable standards.

To make a return in the context of exercising a manufacturer's warranty, the Customer must only contact the Store's customer service department at the following e-mail address: hello@odace.co, provided with proof of purchase of the Products. The customer service of the e-store will provide him with the instructions to follow.

Article 11 – Transfer of ownership

The Product(s) ordered by the Customer become the property of the Customer upon payment of the total amount of the order, including all taxes and delivery.

Article 12 – Partial nullity

If one or more provisions of these TOS are deemed invalid pursuant to a standard in force or a final decision issued by a competent court, the provisions not affected by this invalidation remain applicable in their entirety.

Article 13 - Applicable Law and Jurisdiction

The present TOS are subject to French law. In the event of a dispute arising between the Customer and the Seller, the parties shall favour an amicable resolution of the dispute by having recourse to a Mediator. Any dispute relating to the interpretation and/or execution of these TOS is subject to the jurisdiction of the French courts.

Annexe 1 : Code de la Consommation

1 – Clauses abusives

Article L132-1, Modifié par Ordonnance n°2016-131 du 10 février 2016 – art. 6, Abrogé par Ordonnance n°2016-301 du 14 mars 2016 – art. 34 (VD)

Dans les contrats conclus entre professionnels et non-professionnels ou consommateurs, sont abusives les clauses qui ont pour objet ou pour effet de créer, au détriment du non-professionnel ou du consommateur, un déséquilibre significatif entre les droits et obligations des parties au contrat.

Un décret en Conseil d’Etat, pris après avis de la commission instituée à l’article L. 534-1, détermine une liste de clauses présumées abusives ; en cas de litige concernant un contrat comportant une telle clause, le professionnel doit apporter la preuve du caractère non abusif de la clause litigieuse.

Un décret pris dans les mêmes conditions détermine des types de clauses qui, eu égard à la gravité des atteintes qu’elles portent à l’équilibre du contrat, doivent être regardées, de manière irréfragable, comme abusives au sens du premier alinéa.

Ces dispositions sont applicables quels que soient la forme ou le support du contrat. Il en est ainsi notamment des bons de commande, factures, bons de garantie, bordereaux ou bons de livraison, billets ou tickets, contenant des stipulations négociées librement ou non ou des références à des conditions générales préétablies.

Sans préjudice des règles d’interprétation prévues aux articles 1188, 1189, 1191 et 1192 du code civil, le caractère abusif d’une clause s’apprécie en se référant, au moment de la conclusion du contrat, à toutes les circonstances qui entourent sa conclusion, de même qu’à toutes les autres clauses du contrat. Il s’apprécie également au regard de celles contenues dans un autre contrat lorsque la conclusion ou l’exécution de ces deux contrats dépendent juridiquement l’une de l’autre.

Les clauses abusives sont réputées non écrites.

L’appréciation du caractère abusif des clauses au sens du premier alinéa ne porte ni sur la définition de l’objet principal du contrat ni sur l’adéquation du prix ou de la rémunération au bien vendu ou au service offert pour autant que les clauses soient rédigées de façon claire et compréhensible.

Le contrat restera applicable dans toutes ses dispositions autres que celles jugées abusives s’il peut subsister sans lesdites clauses.

Les dispositions du présent article sont d’ordre public.

2 – Droit de rétractation

Article L121-20-12, Modifié par LOI n°2010-737 du 1er juillet 2010 – art. 59, Transféré par LOI n°2014-344 du 17 mars 2014 – art. 9 (V)

I.-Le consommateur dispose d’un délai de quatorze jours calendaires révolus pour exercer son droit de rétractation, sans avoir à justifier de motif ni à supporter de pénalités.

Le délai pendant lequel peut s’exercer le droit de rétractation commence à courir :

1° Soit à compter du jour où le contrat à distance est conclu ;

2° Soit à compter du jour où le consommateur reçoit les conditions contractuelles et les informations, conformément à l’article L. 121-20-11, si cette dernière date est postérieure à celle mentionnée au 1°.

II.-Le droit de rétractation ne s’applique pas :

1° A la fourniture d’instruments financiers mentionnés à l’article L. 211-1 du code monétaire et financier ainsi qu’aux services de réception-transmission et exécution d’ordres pour le compte de tiers mentionnés à l’article L. 321-1 du même code ;

2° Aux contrats exécutés intégralement par les deux parties à la demande expresse du consommateur avant que ce dernier n’exerce son droit de rétractation ;

3° Aux contrats de crédit immobilier définis à l’article L. 312-2 ;

4° Aux contrats de prêts viagers hypothécaires définis à l’article L. 314-1.

III.-Le présent article ne s’applique pas aux contrats mentionnés à l’article L. 121-60.

IV.-Pour les contrats de crédit affecté définis au 9° de l’article L. 311-1 conclus selon une technique de communication à distance, le délai de rétractation de quatorze jours ne peut pas être réduit.

L’exercice du droit de rétractation n’emporte résolution de plein droit du contrat de vente ou de prestation de services que s’il intervient dans un délai de sept jours à compter de la conclusion du contrat de crédit. De plus, lorsque le consommateur, par une demande expresse, sollicite la livraison ou la fourniture immédiate du bien ou de la prestation de services, l’exercice du droit de rétractation n’emporte résolution de plein droit du contrat de vente ou de prestation de services que s’il intervient dans un délai de trois jours à compter de la conclusion du contrat de crédit. Toute livraison ou fourniture anticipée est à la charge du vendeur qui en supporte tous les risques.

Le droit de rétractation ne peut être exercé pour les contrats :
1° De fourniture de services pleinement exécutés avant la fin du délai de rétractation et dont l’exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation ;
2° De fourniture de biens ou de services dont le prix dépend de fluctuations sur le marché financier échappant au contrôle du professionnel et susceptibles de se produire pendant le délai de rétractation ;
3° De fourniture de biens confectionnés selon les spécifications du consommateur ou nettement personnalisés ;
4° De fourniture de biens susceptibles de se détériorer ou de se périmer rapidement ;
5° De fourniture de biens qui ont été descellés par le consommateur après la livraison et qui ne peuvent être renvoyés pour des raisons d’hygiène ou de protection de la santé ;
6° De fourniture de biens qui, après avoir été livrés et de par leur nature, sont mélangés de manière indissociable avec d’autres articles ;
7° De fourniture de boissons alcoolisées dont la livraison est différée au-delà de trente jours et dont la valeur convenue à la conclusion du contrat dépend de fluctuations sur le marché échappant au contrôle du professionnel ;
8° De travaux d’entretien ou de réparation à réaliser en urgence au domicile du consommateur et expressément sollicités par lui, dans la limite des pièces de rechange et travaux strictement nécessaires pour répondre à l’urgence ;
9° De fourniture d’enregistrements audio ou vidéo ou de logiciels informatiques lorsqu’ils ont été descellés par le consommateur après la livraison ;
10° De fourniture d’un journal, d’un périodique ou d’un magazine, sauf pour les contrats d’abonnement à ces publications ;
11° Conclus lors d’une enchère publique ;
12° De prestations de services d’hébergement, autres que d’hébergement résidentiel, de services de transport de biens, de locations de voitures, de restauration ou d’activités de loisirs qui doivent être fournis à une date ou à une période déterminée ;
13° De fourniture d’un contenu numérique non fourni sur un support matériel dont l’exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation.

3 – Taux d’intérêts légaux

Article L242-4, Créé par Ordonnance n°2016-301 du 14 mars 2016 – art.

Lorsque le professionnel n’a pas remboursé les sommes versées par le consommateur, les sommes dues sont de plein droit majorées du taux d’intérêt légal si le remboursement intervient au plus tard dix jours après l’expiration des délais fixés aux premier et deuxième alinéas de l’article L. 221-24, de 5 % si le retard est compris entre dix et vingt jours, de 10 % si le retard est compris entre vingt et trente jours, de 20 % si le retard est compris entre trente et soixante jours, de 50 % entre soixante et quatre-vingt-dix jours et de cinq points supplémentaires par nouveau mois de retard jusqu’à concurrence du prix du produit, puis du taux d’intérêt légal.

4- Garantie légale de conformité

Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l’emballage, des instructions de montage ou de l’installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.
